vivo Mobile Communication Co., Ltd. (hereinafter referred to as "vivo", "we", "us", or "our") is committed to the protection of your personal privacy and personal information. This Policy is provided to help you understand the information collection and usage rules regarding your use of the Origin Notes service (hereinafter referred to as "this Service"). Please read the Origin Notes Privacy Policy carefully (text in bold in particular) and make sure you understand how we process your personal information. Origin Notes is the daily memo service vivo provides for you.

1. Collection, use, and protection of personal information

vivo respects your privacy and personal data and will do our best to protect your privacy and personal data during your use of this Service. To ensure the accuracy of notes as well as to improve the quality of this Service, we will collect, analyze, and process the information below with the following purposes:

1.1 Core features
Some features (including Jovi Vision, AI services, vivo Docs, and Calendar) require support from underlying system capabilities. We need to collect the version numbers of these apps to identify whether they are compatible with this Service and help you make edits by accessing your clipboard information (which will be identified locally without being uploaded to our server). See below for the information collection rules of each feature:

  •  Sharing and drag & drop
    The sharing and drag & drop features allow you to share files or add notes by dragging and dropping them between this Service and other apps. We need to request permission for the list of installed apps to access the content shared or dragged from Origin Notes. To use this feature in Origin Notes, we need to access your media file library to read images, audio, videos, and text in your device. This information will only be processed locally and will not be uploaded to the server.
  •  Document management feature
    In order for you to use the document management feature to view, create, modify and edit documents on your device, we will scan your media file library to read the document data on your device so that the data can be displayed on the document page of Origin Notes. This information is only processed locally and will not be uploaded to the server.
  •  Smart Tracking
    The Smart Tracking service on your phone helps track your finances by automatically identifying the content of your statements or notifications. Currently, this feature has been moved or will be moved to vivo Wallet. After migration is completed, we will no longer collect your finance tracking information. Your past tracking data is stored on your device. You can go to Settings > Tracking relocation notice > Export past statements to export your tracking data. vivo will not control such data, and you will be unable to obtain the data in Origin Notes after the export. To help you migrate the data, we need to collect your device identifiers (including the IMEI and VAID) to distinguish specific content. You understand that Smart Tracking is only available on some versions of phones. If it is not available to you, we will not process such information.
  •  Dictation
    You can use the Dictation service to generate text and voice notes. When you tap the Dictation button and trigger dictation, we will upload the relevant audio to the server to recognize the audio content and display the converted text on the current dictation page. If Also Save Audio is enabled, your audio messages will be saved on your device. If Automatically Add Location Information is enabled, your location information will also be shown on the current page. The location information in this Service will only be stored locally and will not be collected or uploaded to our server. None of the uploaded audio messages will be stored on the server after parsing is completed. When the feature is activated for the first time, we need to collect your device identifiers, including the IMEI (for phones), serial number (for vivo tablets) and VAID, for server offload.
  •  Lifestyle backup
    Origin Notes provides you with to-do, doc scan, doodle, and table functions to help you generate intuitive notes with images and text. You can add or import existing content to your notes. This service will store the information you record or import on your device, including the text, images, audio, and other information you provide, but will not upload it to our server.
  •  Data sync
    The data sync service requires you to use your vivo account as your credentials. Accordingly, we need to access your vivo account information (including your nickname, profile picture, phone number, OpenID, and email address). We will not upload the data you record. If you want to avoid accidental deletion or sync the data you have recorded after replacing your device, you can choose to sync data to the cloud. When data sync is enabled, the data you choose to sync will be uploaded to our cloud server. To ensure the security of your data, you can upload the images, audio, videos, and text data on your device to the cloud for storage. This information is uploaded by you to the server.
  •  Reminders
    This feature allows you to set reminders for your notes/to-dos. After setting, this feature will remind you at the set time point. You can add your notes information to Calendar events so that Calendar will obtain the notes content from your device for display and reminding. This information is provided by you and processed locally without being uploaded to the server. When you are setting or updating reminders, the reminders will be added to Calendar events after we obtain your consent. In this case, we need to obtain your Calendar events information. This information is provided by you and processed locally without being uploaded to the server.
  •  AI Creation
    This feature allows you to select text in a note to intelligently modify the content of the note or continue creation. Alternatively, you can select template instructions or custom instructions to automatically generate relevant content in the note. In this case, we will collect and use the OpenID and vivo token information of your vivo account. This information is provided by you and uploaded to the server.
  •  AI Drawing
    On a vivo tablet, you can use this feature for AI doodling and AI drawing. In this case, we will collect the OpenID of your vivo account. This information is provided by you and uploaded to the server.
  •  OCR
    On a vivo tablet, you can use the OCR feature to recognize and extract text in images and add the text to your notes. To implement this feature, we need to process your images locally to recognize and extract text for you to add to your notes.
  •  Doodle notes search
    On a vivo tablet, you can add doodle notes to Origin Notes with a stylus. When you use the doodle notes search feature, we will process your doodles locally to recognize the text in them in order to display matching search results.
  •  Troubleshooting
    When an app exception occurs or when you report an issue during use, we may collect the app exception log, including your device identifiers such as the IMEI (for phones), serial number (for vivo tablets), and VAID, to perform analysis, push updates, or troubleshoot other issues.

    Note: The device identifiers (such as the IMEI) will only be requested on phones running Android versions earlier than 10.

    1.2 Non-core features

  •  User Experience Improvement Plan
    To continuously improve your experience with this Service, we may collect and use your service usage behavioral data, including the names of the specific services you choose to enable, information about your specific service preferences, and the original text content of your notes and the content you enter in the note input box during your use of this Service. This information collected from you will be used only to analyze issues and errors that occurred or may occur during the use of this Service to improve your product experience. Such information will not be associated with your personal identity. If you want to opt out of the User Experience Improvement Plan, you can disable it by going to Me > Settings > User Experience Improvement Plan. Once the plan is disabled, we will not track or analyze the data collected for the User Experience Improvement Plan.

    2. Sharing, passing on, and transfer of personal information

    We will only share your personal information under the following circumstances:
    1) Sharing with specified third parties. With your explicit consent, we will share your personal information with the specified third parties within the scope of your authorization.
    2) Share with specific organizations as required by law. According to relevant laws and regulations, we need to provide your personal information to assist in investigations.
    3) Sharing with business partners. When you choose the services jointly provided by us and our business partners, to ensure the services work properly, we will share your personal information with our business partners on a legitimate, reasonable, and necessary basis. Our business partners may include various technical service providers, content providers, and other providers.
    4) Sharing with business stakeholders. In order to maintain risk control and business operation, we will share your relevant information with our stakeholders.
    5) Other circumstances where, according to applicable laws and regulations, we do not need to obtain your prior consent:

  •  When the personal information is required for the formation and performance of a contract of which you are a party, or for human resource management in accordance with legally formulated labor regulations and policies as well as collective contracts signed in compliance with law.
  •  When the personal information is required to fulfill statutory duties or obligations.
  •  When the personal information is required to respond to public health emergencies or to protect the life, health, and property of any natural person in an emergency.
  •  Where the personal information is necessary for activities conducted in the public interest, such as news reporting and supervision by public opinion.
  •  When the personal information processed within a reasonable scope is disclosed by yourself or through other lawful channels.
  •  Other circumstances as stipulated by laws and regulations.

    3. Personal information management

    3.1 Query, deletion, and modification
    3.1.1 The information recorded in Origin Notes is stored on your device. You can edit, modify, and delete your notes, as well as manage the generation and storage of such information via relevant service settings. If you find any errors in the recorded information, you can open the Origin Notes app at any time to manually edit and correct relevant information to improve the accuracy of the information recorded.
    3.1.2 You can query and modify synced information on relevant Origin Notes pages.

    3.2 Withdrawal of authorization
    3.2.1 If Also Save Audio is enabled, your audio messages will be saved on your device. If Automatically Add Location Information is enabled, your location information will also be displayed on the current page. The location information in this Service will not be collected or uploaded to our server. None of the uploaded audio messages will be stored on the server after parsing is completed. If Data Sync is enabled, the data stored on your device will be synced to the cloud. You can disable certain services or permissions to manage the storage of such information. When the services or permissions are disabled, such information will no longer be stored or displayed.
    3.2.2 For features without a specific management path, you can request the execution of your rights by calling our customer service at 95033, visiting https://www.vivo.com to contact our online service agents, or sending an email to privacy@vivo.com.

    3.3 Account management and deletion
    By tapping your profile picture, you can go to account settings to access, modify, or delete your personal information such as your vivo account, profile picture, and nickname, your security phone number or security email address, and other information. You can also request to delete your account on this page.

    4. Personal information protection

    The aforementioned personal information collected or uploaded will be stored within the People's Republic of China and will be anonymized or deleted after the relevant service feature is completed. For matters not covered by this Privacy Policy, such as information security and execution of personal information rights, please refer to the vivo Privacy Policy at https://www.vivo.com.cn/about-vivo/privacy-policy.

    5. Protection of minors' personal information

    Please understand that our services are mainly provided for adults. Minors need to obtain their guardians' consent to use this Service. If your guardians do not permit your use of this Service, they can request us to delete your personal information collected.

    6. Updates to this Policy

    vivo reserves the right to update or modify this Policy from time to time. vivo shall notify you of the updates or modifications as well as where you can view them via pop-up windows.

    7. How we store and protect your personal information

    In order to comply with laws and regulations as well as regulatory requirements and make it easier for you to check your personal information, we will store the necessary information provided by you or generated during your use of this Service. We will implement physical or logical isolation mechanisms to store your general personal information separately from your sensitive personal information. We will use security measures such as encryption to protect your sensitive personal information.

    (I) Storage location

    Your personal information that is collected or generated in China will be stored on our server located within China. If in the future some services involve cross-border business and require the transfer of your personal information to an institution outside China (overseas institution), we will conduct a prior security assessment in accordance with laws and regulations as well as regulatory requirements, explain to you the purpose of cross-border transfer, the type of personal information involved, the identity and data security capability of the recipient, and possible security risks, and obtain your prior consent. We will also clarify the obligations and responsibilities of the parties involved through agreements, supervision and verification mechanisms, security audits, and other effective measures and require the overseas institution to keep the personal information it receives confidential.

    (II) Retention period and data processing after expiration

    We will store the information you provide and generate when using this Service in accordance with the provisions of laws and regulations such as the Personal Information Protection Law and the Cybersecurity Law. We will retain your personal information for the minimum period needed to fulfill the purposes as described in this Privacy Policy (with consideration of the requirement for network log retention time, statute of limitations, and other factors), unless otherwise specified by laws and regulations. When the retention period for your personal information expires, we will delete or anonymize your personal information.

    In addition, we will protect your personal information with reasonable security precautions and programs, including but not limited to security checks and encryption tools and software. If we stop operating this Service or if you stop using this Service, we will no longer collect or use any of your information, and we will anonymize or delete the information we store.

    8. Security of your information and data and measures taken to protect them

    To protect the integrity of the network, the vivo IT data network has taken the following measures (including but not limited to): security checks, encryption tools and software, and other appropriate security measures and procedures. Only network administrators and relevant personnel with a need to use the data have internal access. If vivo learns that the security of the vivo IT data network is compromised or users' non-public information is disclosed to irrelevant third parties due to external actions (including but not limited to external security attacks), notwithstanding other regulations in this Privacy Policy, vivo shall still take any measures they deem as appropriate, including but not limited to internal investigations, reporting to law enforcement agencies, and cooperation with law enforcement agencies.

    For the purpose of protecting the system or services and network security, vivo shall reserve the right to disclose the information contained in the access log of any users, especially when users violate current or future terms of use or other published principles, or when users initiate or participate in (or are reasonably assumed to have initiated or participated in) any illegal activities.
